It typically permits forgiveness of most types of debt, including credit card debt, medical bills, second mortgages and other unsecured debt. Consumers are permitted numerous exemptions, including exemptions for up to $60,000 in housing equity and $5,000 in vehicle equity as well as exemptions for retirement accounts, personal belongings and other assets.
  • Chapter 13 Bankruptcy: Available to consumers who don’t qualify under Chapter 13 or who have significant assets they wish to keep. Filing for Chapter 13 permits a consumer to establish a 3- to 5-year repayment plan. Unpaid, unsecured debt at the end of the plan is typically forgiven.
